The AMTF Avvocati law firm obtained the annulment of Resolution 575/2017/R/GAS, whereby the Regulatory Authority for Energy, Networks, and Environment (ARERA) had determined the amount of the tariff applicable for gas transport on the national network for 2018 and 2019 in a manner unfavorable to thermoelectric operators (as well as for all large industries with withdrawal points on the gas transport network).
The Lombardy Regional Administrative Court, Second Section, recognized that the current tariff framework, which is based 90% on booked capacity and only 10% on actual consumption, in addition to the higher contribution required from owners of withdrawal points on the transmission network (known as "exit"), is contrary to the applicable regulatory framework and must therefore be annulled.
The appellant companies, including Axpo Italia, Sorgenia, Tirreno Power, RePower, and other leading energy producers, worked closely with external lawyers.
